Based on Article 13 of the Swiss Federal Constitution and the data protection provisions of the Federal Data Protection Act (DSG), every person has the right to privacy and protection against the misuse of their personal data. We comply with these provisions. Personal data is treated strictly confidentially and is neither sold nor passed on to third parties.

In close cooperation with our hosting providers, we strive to protect the databases as well as possible from unauthorized access, loss, misuse, or falsification.

When accessing our websites, the following data is stored in log files: IP address, date, time, browser request, and general information transmitted about the operating system and browser. This usage data forms the basis for statistical, anonymous evaluations, so that trends can be identified, allowing us to improve our offerings accordingly.

Seehotel Adler AG operates the website www.livinn.ch (hereinafter referred to as "we"). On this website, you can learn about our organization, use our online services, and contact us. Protecting your personal data is very important to us. In this privacy policy, we inform you transparently and understandably about what data we collect through our website and how we handle it.

2. What do we use?

We use Google Analytics, a service provided by Google Ireland Ltd., Google Building Gordon House, Barrow St, Dublin 4, Ireland, and Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA; collectively "Google," with Google Ireland Ltd. being responsible for processing personal data. Google uses cookies that are stored on your device and enable an analysis of your use of the website. The information generated by the cookie about your use of the website is transmitted to a Google server in the USA and stored there.

2.1 Why are we allowed to use Google Analytics?
Google evaluates the collected data on our behalf so that we can get an idea of the visits and user behavior on our website. This allows us to improve our services and the content and design of the website.

3. How do we use your data?

We mainly need your data to process and fulfill your booking. We may also need the data to identify you as our customer, to correspond with you, for billing purposes, to assert any claims, and to manage our customer data.

3.1 What information do we pass on to third parties and how is this data used?
Your data is treated confidentially and only passed on to third parties as necessary for contract processing. For the processing of your booking, your name and address must be transmitted to b_smart Selection AG, Industriestrasse 2, 9487 Gamprin-Bendern, Principality of Liechtenstein. The payment and contact details you provide are passed on for payment processing and dunning purposes. b_smart Selection AG acts on our behalf and may not use the transmitted data for its own purposes.

We also use Fonts.com API services to display content on our website with fonts from Fonts.com. The provider is Monotype Imaging Holdings Inc., 600 Unicorn Park Drive, Woburn, Massachusetts 01801 USA. When you access this website, your browser loads the required fonts directly from Fonts.com to display them correctly on your device. This allows Monotype to know that your IP address has accessed this website. According to Monotype, no cookies are stored when providing the fonts.

General Terms and Conditions of Seehotel Adler AG

1. Scope, Contracting Parties and Conclusion of Contract

These terms and conditions apply to contracts for the rental of rooms for accommodation as well as all related services provided by Seehotel Adler AG and its affiliated operations, represented by Seehotel Adler AG, Zugerstrasse 2, 6415 Arth, Switzerland.

The following establishments belong to Seehotel Adler AG:

Hotel LIVINN Arth

The contracting parties are the customer, hereinafter referred to as the Guest, and Seehotel Adler AG. If a third party has booked one or more rooms for the Guest, that third party shall be jointly and severally liable with the Guest for all obligations arising from the concluded contracts. In this case, the Guest and the third party are jointly liable.

A contract is concluded upon written confirmation by the Guest and Seehotel Adler AG. Written confirmations also include electronically transmitted documents such as emails and online-generated forms. The agreed services are legally binding for both Seehotel Adler AG and the Guest. Seehotel Adler AG sends an electronic booking confirmation to the Guest.

Subletting or otherwise transferring the rented rooms to third parties and their use for purposes other than accommodation require prior written consent from Seehotel Adler AG.

By concluding the contract, the Guest acquires the right to the usual use of the rented rooms and the facilities of Seehotel Adler AG establishments that are normally accessible to the Guest without special conditions. The Guest acknowledges that staff availability is very limited and that self-responsibility is required.

2. Booking and Cancellation

Booking is done online or via the check-in terminal. Seehotel Adler AG will charge the full booked amount to the provided payment method as soon as the booking is no longer cancellable free of charge. If the deposit is not paid on time, Seehotel Adler AG may withdraw from the contract (including all performance promises) immediately (without notice) and claim cancellation fees.

Charges are made via credit or debit card.

The Guest has no claim to specific rooms unless explicitly agreed.

Cancellation is free within the cancellation period corresponding to the booked rate. For late cancellations or no-shows, the full stay will be charged. No free cancellation right exists for booking classes marked as non-refundable or non-changeable rate.

If a free cancellation right within a certain period has been agreed in writing, Seehotel Adler AG may also withdraw during this period if other requests for the booked rooms exist and the Guest does not waive their right upon inquiry.

Furthermore, Seehotel Adler AG may withdraw from the contract extraordinarily, for example if:

  • Force majeure or other circumstances beyond Seehotel Adler AG’s control make fulfillment impossible (e.g., pandemic);
  • Rooms are booked under misleading or false information of essential facts (e.g., guest identity, number, age if relevant for price calculation, or purpose);
  • There is reasonable grounds to believe that the use of services endangers smooth operations, safety, or reputation;
  • The Guest makes significantly improper use of premises or behaves grossly inappropriate;
  • The Guest suffers from a contagious disease or requires care beyond the stay;
  • The stay is unlawful.

In such cases, the Guest has no claim for damages.

3. Check-in and Check-out

Check-in is via the designated terminal or the Guest’s mobile device. The room key is provided after check-in via the terminal or mobile device. Physical keys must be returned in the designated key drop upon departure. Rooms are available from 3:00 PM on arrival day and must be vacated by 11:00 AM on departure day. Late check-out may incur an extra day’s charge. Rooms used before 7:00 AM count as the previous night.

4. Prices and Payment Methods

All prices are in Swiss francs including VAT. Prices are based on the contract or underlying price list. Changes in booking may result in price adjustments.

Accepted payment methods:

  • Visa
  • Mastercard
  • Invoice (if agreed before booking)

No cash or check payments are possible due to the absence of staffed reception.

5. Smoking and Fire Safety

Fire safety regulations apply throughout all buildings. Only provided equipment may be used. Tampering with fire alarms incurs a minimum penalty of CHF 1,000 plus additional costs. Smoking indoors is prohibited. False or abusive fire alarms incur at least CHF 1,000 plus fire department costs.

6. Children

Baby cots must be reserved by email at least 24 hours before arrival. Prices per price list. Children’s ages must be correctly stated; discrepancies will result in price adjustments.

7. Pets

Pets require prior approval. Guests must notify in advance. Approved pets must be supervised, healthy, and pose no danger. Pets are not allowed in breakfast areas or bars. Fee: CHF 20 per night; own basket or blanket required. Hotel textiles are for personal use by the Guest only; extra cleaning costs (such as external dry cleaning) will be charged.

Exceptions: guide dogs and similar service dogs (free of charge). Excessive cleaning costs apply even for service dogs.

8. Parking

A limited number of complimentary parking spaces is available to Guests; however, parking cannot be guaranteed. Additional public parking spaces subject to fees are located in the immediate vicinity. Seehotel Adler AG accepts no liability for damage to vehicles, theft, or any other loss or damage occurring during the Guest’s stay.

For fire safety reasons, vehicles parked unlawfully may be towed at the owner’s expense.

9. Services

Snacks, drinks, and toiletries available for purchase. Breakfast and drinks during breakfast are included. 
Guests may use laundry facilities and must leave them clean.

10. Liability

Seehotel Adler AG is liable for Guest belongings only under legal provisions and if items were handed over or placed in designated areas. Liability for slight negligence is excluded. Complaints must be reported immediately; otherwise, no claims can be made. 

All claims expire six months after departure unless law provides longer periods.

11. Internet

Seehotel Adler AG provides complimentary wireless internet access (Wi-Fi).
Seehotel Adler AG accepts no liability for internet malfunctions, damages caused by third parties, or for any data imported through the network (including viruses, worms, Trojan horses, etc.), nor for links to and from external websites. Seehotel Adler AG has no control over the content or design of external websites.

Seehotel Adler AG does not warrant the error-free operation of hardware or software. Please note that this website may contain technical inaccuracies or typographical errors.

In no event shall Seehotel Adler AG be liable to the guest or any third party for any direct, indirect, special, or consequential damages arising from the use of this website or any linked websites. This exclusion of liability also applies to lost profits, business interruption, loss of programs, or other data in the guest’s information systems, even if the possibility of such damages has been expressly pointed out.

12. Lost Property

Lost property will be forwarded to the guest upon request, provided that ownership can be clearly established and the guest’s home or business address is known. The guest shall bear all costs and risks associated with the forwarding.

13. Data Protection

Seehotel Adler AG is committed to maintaining the confidentiality of guests’ personal data. Seehotel Adler AG may provide access to content or services from external websites via links on this site. These external websites are not subject to the data protection policies of Seehotel Adler AG. Guests are advised to review each of these websites individually to determine how personal data is protected.

By providing personal data to Seehotel Adler AG for communication or reservation purposes, the guest acknowledges that the hotel may use such data for marketing purposes. The confidentiality of emails and other forms of electronic communication cannot be guaranteed.

Seehotel Adler AG processes personal data in accordance with the Swiss Data Protection Act (DSG) and the EU General Data Protection Regulation (GDPR). Guests have the right to request access to, rectification or deletion of their personal data, as well as the right to withdraw consent. All inquiries should be directed to: info@livinn.ch.

14. Final Provisions

All information provided (including but not limited to prices, reservations, and online calculations) is supplied without guarantee. Seehotel Adler AG cannot ensure that such data is always complete, accurate, or up to date. Seehotel Adler AG reserves the right to modify or update any information on this website at any time and without prior notice. This also applies to improvements and/or changes to the products or services described on this site.

Any amendments or additions to the contract or to the reservation confirmation should be made in writing whenever possible. Unilateral amendments or additions are invalid.

By completing a booking, the guest accepts these Terms and Conditions.

This contract and any disputes arising from it shall be governed exclusively by Swiss law.
